Almost all of the traffic offences under the Ontario Highway Traffic Act are defendable if handled in a professional manner. This involvement and understanding can be very beneficial to the outcome of your case.

Get professional assistance to get your fines and penalties reduced for charges such as:

  • Speeding
  • Failure to stop at a red light
  • Careless driving
  • Stunt driving
  • Driving without a licence
  • Driving without insurance
  • Failure to remain at an accident

Speeding

Fines and penalties assigned for speeding violations depend on how many kilometers you were going over the speed limit. The more kilometers over the limit, the higher the fine. Speeding violations can also come with demerit points. Here is the breakdown:

  • 0-15 kms over the limit – 0 points
  • 16-29 kms over the limit – 3 points
  • 30-49 kms over the limit – 4 points
  • 50+ kms over the limit – 6points

If you are charged with traveling in excess of 50 kilometers over the limit, you will be assigned 6 demerit points, your licence will be suspended, and you may even be charged with stunt driving or racing.

Failure to Stop at a Red Light

This offence may not seem overly serious, but the penalties can be. Most people that commit this offence roll though an empty intersection because there is no traffic for miles in either direction. However, failure to come to a complete stop at a red light or stop sign can result in a fine, 3 demerit points, and blemish on your driving record for 3 years if convicted.

Careless Driving

Careless driving is a fairly expansive charge that is usually associated with an accident of some sort. It basically means not taking due care and considering other motorists while operating a motorized vehicle. This charge is a very serious one and can incur the following penalties:

  • A fine of $200-$2000
  • 6 demerit points
  • Possible licence suspension
  • Possible jail sentence of up to 6 months

Due to the severity of the possible penalties, it is highly recommended to seek legal counsel for this type of charge.

Stunt Driving

Stunt driving is characterized by excessive speeds and ill-advised, dangerous maneuvers. This charge comes with an immediate, seven-day, roadside suspension of your vehicle. There is a possibility of an extended suspension, fines from $2000-$10,000 and a jail sentence of up to 6 months.

Driving Without a Licence

Anyone that operates a vehicle without a valid driver’s licence is subject to this charge. That includes licences that were at one point valid, but have now expired. A conviction results in a fine plus a 3-year blemish on your driving record.

Driving Without Insurance

No motorized vehicle is allowed to be operated without valid insurance. A conviction for this offence will result in heavy fines ($5000-$10000), as well as a possible licence suspension.

Failure to Remain at an Accident

This law states that anyone involved in a motor vehicle accident shall not flee the scene. The drivers of the vehicles involved in the collision are required to exchange personal and insurance information.

Penalties for this offence are quite harsh if convicted, including 7 demerit points, $200-$2000 fines, possible licence suspension, possible jail term of up to 6 months.
